U.S. Patent Applicants: Beware the Ides of March!

Abstract

March 15, 2013, is the last day to file applications before changes in current U.S. patent law. These changes will impact patents filed for water treatment products and technologies. If your company is considering filing patent applications for its technology, it may be important that those applications be filed by March 15, 2013. Applications filed by that date are entitled to benefits under existing U.S. patent law. The America Invents Act (モAIAヤ) makes changes to the law, effective on March 16, 2013, for applications filed on or after March 16, and the changes can prevent or limit claims for patent protection. If you would like to file patent applications by March 15, we recommend that you start the process immediately, since the drafting and filing of a patent application typically requires several weeks of preparation, including communication with inventors. Here are some of the possible pitfalls in waiting beyond March 15, 2013, to file a U.S. patent application:
